Shipping policy

This Shipping Policy applies to consumer orders placed with TYTAX FACTORY A.S. SZULTKA S.C. through our online store. It should be read together with the Online Store Terms and Conditions and the Withdrawal, Returns and Refund Policy.

1. Delivery Area and Restrictions

We deliver orders to all Member States of the European Union. Delivery availability for a specific address is verified during checkout.

Any restrictions relating to postal codes, islands, remote areas, access conditions, military addresses, post office boxes or other special locations are shown to the customer before the order is placed, where applicable.

If the available freight network does not serve the address provided, we will contact the customer before dispatch and propose an available alternative solution or issue a refund.

2. Preparation and Delivery Times

The estimated preparation and delivery time is calculated for each order and presented to the customer during checkout. It may also be stated in the order confirmation or in a later communication concerning delivery arrangements.

We do not use a general delivery timetable. The delivery time depends, among other things, on the selected product, the delivery location, carrier availability and the freight preparation required.

Due to the size and weight of TYTAX products, order preparation may include warehouse handling, securing the shipment and arranging the delivery date with the carrier.

Unless a different time has been expressly agreed, delivery will be completed without undue delay and within the period required by applicable consumer law. If we are unable to deliver the order within the agreed time, the customer retains all statutory remedies available in the event of delay or non-delivery.

3. Delivery Costs, VAT and Additional Services

The total order price, including delivery costs and applicable VAT, is presented before the order is placed.

Prices for deliveries offered through the online store include VAT. The customer is not charged additional import duties or brokerage fees.

Optional services, such as carrying the product inside, delivery to a selected room, assembly, installation, weekend delivery or delivery within a specified time window, are included in the order only where they have been expressly offered, selected and confirmed before the order is placed.

4. Freight Delivery and Delivery Arrangements

Due to the size and weight of TYTAX equipment, it is generally delivered by a freight carrier.

The carrier may contact the customer to arrange or confirm a delivery date or time window. The customer should provide a valid telephone number and complete information about the address and access conditions.

Delivery time windows are estimates unless expressly guaranteed. We remain responsible for fulfilling our delivery obligations under the contract and applicable law.

5. Access and Receipt Requirements

Where required by the carrier, an adult must be present to receive the shipment.

The road, driveway, gate, entrance and unloading area must be suitable and safe for the delivery vehicle and the selected service level.

Before placing an order, the customer should inform us of any known restrictions, such as narrow roads, weight restrictions, low bridges, stairs, restricted unloading areas, gated access or limited access hours.

Reasonable and documented additional carrier costs resulting from an incorrect or undisclosed address or access information may be charged to the customer only where the customer has been informed of that possibility and applicable law permits it.

6. Standard Unloading Service

Standard freight delivery includes curbside delivery, or delivery to the nearest safe location accessible to the delivery vehicle at the delivery address, and unloading the shipment from the vehicle to ground level using a tail lift.

Unless a different service has been expressly purchased, standard delivery does not include:

  • carrying the equipment into a building, garage, room, basement or upper floor;
  • moving the shipment through doors, stairs, lifts or narrow passages;
  • assembly, installation or positioning of the equipment;
  • unpacking the equipment or removing the pallet, packaging or protective materials.

The scope of any additional service is presented before the order is placed, where that service is available.

7. Risk of Loss or Damage

We bear the risk of loss or damage until the customer, or a third party designated by the customer other than the carrier, physically receives the goods.

If the customer independently appoints a carrier that we did not offer, the risk may pass to the customer when the goods are handed over to that carrier, subject to applicable law.

8. Inspection on Delivery and Reporting Damage

On receipt, the customer should inspect the pallet, packaging, labels, number of items and the visible condition of the shipment.

If there is visible damage, missing items, crushing, punctures, signs of opening or any other irregularity, the customer should:

  • record the issue on the carrier's delivery document;
  • take photographs of the shipment and the damage;
  • retain the packaging and protective materials;
  • contact us promptly through the contact form.

Failure to inspect the shipment or record visible damage on delivery does not deprive the customer of any mandatory rights relating to damaged, defective, missing or non-conforming goods.

9. Delays, Failed Delivery and Rescheduling

Weather conditions, carrier disruption, traffic, strikes, events beyond our reasonable control or access problems may affect the estimated delivery time. We will provide the customer with updates when reasonably available.

If delivery fails because the recipient is absent, the address is incorrect, access information is incomplete or delivery is refused without a legal basis, the carrier may charge storage, redelivery, address correction or return transport fees.

The customer may be charged only costs that are reasonable, documented, permitted by law and disclosed where required.

Where a delay gives the customer a statutory right to set an additional deadline, cancel the order or receive a refund, this Policy does not restrict that right.

10. Changes to Delivery Details

If the delivery address or telephone number needs to be changed, the customer should contact us without delay.

We cannot guarantee that delivery details can be changed after the freight shipment has been prepared or handed over to the carrier. If the change is possible and involves an additional cost, that cost will be presented to the customer before the change is approved.

11. Deliveries Within the European Union and Individually Arranged Deliveries Outside the EU

The online store sells and accepts orders for delivery only to addresses located in Member States of the European Union. Orders with a delivery address outside this area cannot be placed through the online store.

A customer interested in delivery to a country or address outside the European Union may contact us through the contact form. After receiving information about the selected product and the full delivery address, we will assess the possibility of fulfilling the order individually and, where delivery is possible, prepare a separate quotation setting out the conditions, estimated delivery time and transport cost.

Such sales and deliveries are arranged individually outside the standard online-store ordering process. Availability depends, among other things, on the destination country and address, carrier availability, transport restrictions, import regulations and other requirements applicable at the destination.

We do not discriminate against customers solely on the basis of nationality or place of residence to the extent that European Union geo-blocking rules apply. Delivery availability and price may nevertheless differ for objective reasons, including carrier coverage, the specific address, access conditions and transport costs.
